1. 1. Preamble By accessing this website (including all material contained therein), you declare your assent to the following terms and conditions as well as our acceptable use policy. Please read them carefully.

Access By accessing the Ratemytinydick website, you certify that you are at least 18 years of age; you’re using Ratemytinydick solely for personal, non-commercial purposes; you will not copy or distribute any part of the website without Ratemytinydick prior written authorization; you will fully comply with the terms and conditions of these terms of service as well as our acceptable use policy. Once you have registered/become a member of the Ratemytinydick website, there is no way to remove your account or any uploaded media without paying the termination fee.

Intellectual Property Rights The Ratemytinydick website, except all user submissions (as defined below), including without limitation, the text, software, visuals, sounds, music, videos, interactive features and the like (content) and the trademarks, service marks and logos contained therein (marks), are owned by or licensed to Ratemytinydick. You may not use, copy, reproduce, distribute, broadcast, display, sell, license, or otherwise exploit them for any other purposes without the prior written consent of their respective owners.
   4. User Submissions
   5. Ratemytinydick allows its users to submit pictures or other material and the hosting, sharing, and/or publishing of such submissions. You shall be solely responsible for your own submissions and the consequences of posting or publishing them. In connection with your submissions, you affirm/warrant that:

1. • You own or have the necessary licenses, rights, consents, and permissions to use and authorize Ratemytinydick to use all patent, trademark, trade secret, copyright or other proprietary rights in and to all submissions to enable inclusion and use of the submissions in the manner contemplated by these terms of service; and
   • You have the written consent, release, and/or permission of each and every identifiable person in the submission to use the name or likeness of each individual for use in your submissions in the manner contemplated by these terms of service.
   • You retain all of your ownership rights in your submissions. However, by submitting the material to Ratemytinydick, you grant a worldwide, non-exclusive, royalty-free, sub-licenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the submission in connection with the Ratemytinydick website and business.

1. 1. You further agree that you will not:

1. • Submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant Ratemytinydick all of the license rights granted herein;
   • Publish falsehoods or misrepresentations that could damage Ratemytinydick or any third party;
   • Submit material that is unlawful, threatening, harassing, hateful, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate;
   • Post advertisements or solicitations of business;
   • Impersonate another person.

Ratemytinydick does not endorse any user submission, and expressly disclaims any and all liability in connection with user submissions.

Ratemytinydick does not permit copyright infringing activities or infringement of intellectual property rights on its website, and will promptly and without prior notice remove all content and user submissions if properly notified of infringements on third party’s intellectual property rights. Repeat infringers will have their user access terminated.

If you are a copyright owner or an agent thereof and believe that any user submission or other content infringes upon your rights, you may submit a notification pursuant to the Digital Millennium Copyright Act (“DMCA”) by providing our DMCA agent with the following information in electronic form (see 17 U.S.C. 512 (3) for further detail):

1. • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
   • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit the service provider to locate the material;
   • Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, an electronic mail;

You understand that when using the Ratemytinydick website, you will be exposed to user submissions from a wide variety of sources, and that Ratemytinydick is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such submissions. You further understand and acknowledge that you may be exposed to user submissions that are inaccurate, indecent, offensive, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against Ratemytinydick with respect thereto, and agree to indemnify and hold Ratemytinydick and its owners, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the site.
   2. Ratemytinydick permits you to link to materials on the Ratemytinydick website for personal, non-commercial purposes only. In addition, Ratemytinydick provides an “embeddable player” feature, which you may incorporate into your own personal, non-commercial websites for use in accessing the materials contained on the Ratemytinydick website. Ratemytinydick reserves the right to discontinue any aspect of the Ratemytinydick website at any time and for any reason.
   3. Account suspensions / Getting banned

You acknowledge that at ratemytinydick sole discretion your account may get suspended/banned for breaking any of the above rules, or for any reason we see fit, even if it not listed here in the terms. You have the right to appeal the suspension, but ratemytinydick is not obligated or required to reply to your appeal. It is also at ratemytinydick sole discretion  to give or not give warnings before suspended accounts.

Once your account is suspended, you will not be able to login or use any features of the site. Your profile and all media will remain on the site. Unless at ratemytinydick sole discretion decide to remove your account and media without the removal fee being paid.

Accounts frozen/suspended for posting illegal content will have all the content removed, but the profile itself will stay up so Authorities can investigate who uploaded the illegal content.

You acknowledge that you are using ratemytinydick website because we are allowing you to, not because it is your right. Ratemytinydick will suspend accounts at anytime, for any reason. This is a niche fetish site, and subscribing a large number of members is not the goal. We much rather quality, over quantity. If we believe for any reason at all you don’t fit on ratemytinydick site, we will suspend your account. We are under no obligation to explain to you why your account was suspended.
